H-1B Visa Update: New $100,000 Fee For New Applicants

Starting 𝐒𝐞𝐩𝐭𝐞𝐦𝐛𝐞𝐫 𝟐𝟏, 𝟐𝟎𝟐𝟓, all new 𝐇-𝟏𝐁 𝐚𝐩𝐩𝐥𝐢𝐜𝐚𝐭𝐢𝐨𝐧𝐬 𝐟𝐢𝐥𝐞𝐝 𝐟𝐫𝐨𝐦 𝐨𝐮𝐭𝐬𝐢𝐝𝐞 𝐭𝐡𝐞 𝐔.𝐒. will be subject to a 𝐨𝐧𝐞-𝐭𝐢𝐦𝐞 $𝟏𝟎𝟎,𝟎𝟎𝟎 𝐟𝐞𝐞.

𝐓𝐡𝐢𝐬 𝐝𝐨𝐞𝐬 𝐧𝐨𝐭 𝐚𝐩𝐩𝐥𝐲 to existing H-1B holders, renewals, or petitions filed before the effective date.

For 𝐅-𝟏 𝐬𝐭𝐮𝐝𝐞𝐧𝐭𝐬 𝐨𝐧 𝐎𝐏𝐓 applying for a 𝐇-𝟏𝐁 𝐕𝐢𝐬𝐚 within the United States 𝐯𝐢𝐚 𝐚 𝐜𝐡𝐚𝐧𝐠𝐞 𝐨𝐟 𝐬𝐭𝐚𝐭𝐮𝐬 the fee is generally 𝐧𝐨𝐭 𝐫𝐞𝐪𝐮𝐢𝐫𝐞𝐝, – as long as the petition qualifies as a status change rather than a new, consular-based H-1B. However, if the beneficiary travels abroad and needs a visa stamp through consular processing, that new H-1B petition may trigger the $100,000 fee

The rule is set to remain in effect for 12 months, unless extended. Further guidance from USCIS and DHS is expected in the coming weeks.
